Object of the contract:

The general contracting conditions regulate the electronic purchase made by the buyer through the website www.wabihome.com and will be incorporated into the purchase contract at the end of the purchase process.

Wabi Home may modify these general purchase conditions at any time, without affecting, in any case, purchases made before such modifications.

It is the buyer's responsibility to be familiar with these general terms and conditions of sale of Wabi Home.

www.wabihome.com is owned by Wabi Home and Living, S.L. with registered office at Av/ Espioca, 118 46460 Silla (Valencia) with CIF B40549057 and registered in the Valencia commercial register T 10593, F221, H V-185216.

 

Sales system:

To access the purchase of Wabi Home products, it is necessary to register; registration is free and can be done at the end of the purchase process or in the "register" tab located at the top right corner of the website.

The sales process is as follows:

  1. Product selection: Click on "add products" in the products tab of our website on each product you want to add to your "shopping cart." The prices shown on the website are in euros and include fees and taxes.
  2. Start the purchase process: On this screen, you can see the summary of your order, the quantity of each selected product, as well as the respective price. Click on Complete order to proceed.
  3. Registration: If you are already registered, we will ask for your username and password. If not, you must register and we will ask for your first name, last name, email address, and password.
  4. Fill in purchase details: Fill in shipping and contact details.
  5. Order confirmation: Confirm your shipping and contact details and shipping costs.
  6. Select your preferred payment method, by credit or debit card, as well as the secure method of PayPal, Amazon Pay, Google Pay, Apple Pay, or financing. All payment methods are completely secure and guaranteed by banks and financial institutions. Under no circumstances will Wabi Home store your banking data.
  7. Purchase confirmation.

 

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to the user.

Your data is stored through Shopify's data storage, databases, and the general Shopify app. Your data is stored on a secure server behind a firewall.

An order will only be processed after payment validation, so in the case of financing, it will only be shipped on the final approval date of the operation by the financial institution and, in the case of transfers, until the effective credit to the account.


Payments:

If you choose a direct payment gateway to complete your purchase, Shopify will store your credit card data. They are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as necessary to complete the purchase transaction. After completion, the purchase transaction information is deleted.

If you choose Pepper's financing payment method, at the time of payment, we may transmit to Pepper, during the purchase process, your personal data included in the contact form and order details, so that Pepper can assess whether you meet the conditions to access their payment methods and to tailor these payment methods to your profile. All direct payment gateways comply with the standards established by PCI-DSS, as defined by the PCI Security Standards Council, which is a joint effort of brands such as Visa, MasterCard, American Express, and Discover.

Shipping:

Home delivery is made from Monday to Friday. We deliver in Spain and Portugal, except the Canary Islands, Ceuta, Melilla, Madeira, and Azores, and territories outside these countries.

If an order contains items with different delivery times, it will be shipped based on the longest delivery time.

At Wabi Home, we divide our shipments according to the weight and volume of the order.

1. For deliveries in Spain:

Sofas: This system is unique for upholstered sofas, as it is a large volume product; we hire a specialized service. The transport agency will schedule a meeting with you, take it, and assemble the sofa in the location you indicate. This service only includes delivery to homes where the packages fit in the elevator or stairs. If a crane is needed, the customer will pay for it. The transport delivery time is 10 business days from the moment the agency collects it.

*We do not have stock of upholstered sofas in our warehouse because they are made to order. Since we offer customization options (sizes and colors), it is impossible to manufacture in advance; once the order is placed, we need 5 weeks for manufacturing.

Large and medium-sized products:  Delivery is made by 2 delivery people who bring the product to your home and leave it in the room you choose (for example: dining tables, sideboards, display cabinets, bed headboards over 160 cm). The transport delivery time is 10 business days from the moment the agency collects it.

Small products: They will be sent by a courier agency that will deliver the order to the street (for example, chairs, tables, paintings, and decoration products). The delivery time is 5 business days from the moment the agency collects the order.

*For deliveries to the Balearic Islands, the delivery time is 14-16 business days for large products and sofas; and 4-6 business days for small and medium products from the moment the agency collects them.

2. For deliveries in Portugal:

Small, medium, and large products: It will be sent by a courier agency that will deliver the order to the street. The delivery time is 10 business days from the moment the agency collects the order.

 

Shipping costs:

Shipping costs depend on the amount of your order and are calculated at the end of the checkout process as follows:

These prices do not include the assembly and disassembly of furniture, except for sofas and the Natura L table in Spain.

 

Delivery responsibility:

Wabi Home does not guarantee the permanent availability of its products and is exempt from any type of liability.

Likewise, Wabi Home is released from the contract in case of total or partial non-payment by the user, omission, or inaccuracy of the data provided by the buyer.

Orders will be delivered to the address indicated at the time of purchase, so Wabi Home assumes no responsibility when delivery cannot be made due to the data provided being incorrect, inaccurate, or incomplete.

If the recipient is absent at the delivery address, Wabi Home reserves the right to make a second delivery. If the merchandise cannot be delivered for any reason, Wabi Home will coordinate communication between the carrier and the customer, both agreeing on the delivery date.

If access to your home is not easy, it would be advisable to inform the carrier in advance (absence of elevator, narrow stairs, etc.) to facilitate the delivery of your order. If a lift platform service is necessary to access from the facade to the interior of the home, these costs will be borne by the customer.

 

Pickup and returns:

In accordance with the provisions of Spanish legislation, the user has the right of withdrawal, by which they can return the received product if they find that it does not meet their expectations.

Royal Legislative Decree 1/207, Art. 91.1 LGDCU, of November 16, and the right of withdrawal can be exercised within a maximum period of fourteen (14) calendar days from receipt. To exercise this right, the product must be in perfect condition and in its original packaging. The refund will be made after receiving the returned products in our warehouse and may take up to 25 days to be processed.

Return costs incurred in case of cancellation will be borne by Wabi Home in all cases (defective products, products in poor condition, or products that do not meet the customer's expectations). Return expenses are understood as collection and delivery costs to our warehouse (second shipment). The costs of the first shipment will also be borne by Wabi Home, except in case of non-compliance with the customer's expectations.

If the products are not returned in perfect condition, Wabi Home reserves the right to pay an amount less than your order.

In the specific case of made-to-order products (for example, upholstered sofas), the right of withdrawal cannot be exercised (no exchanges, returns, or cancellations). Necessary exchanges will only be made if the product is received with defects.

When the customer requests the cancellation of their order before receiving it, they must contact incidencias@wabihome.com and the following cases are considered:

- The order was not shipped; in this case, the order will be fully refunded.

- The order was shipped but has not yet been received by the customer, in which case the customer will be responsible for the shipping costs.

 

Model for exercising the right of withdrawal:

The following information must be sent to Wabi Home and Living, S.L. with address at Av/ Espioca, 118 in Silla (Valencia) 46460, by email to incidencias@wabihome.com:

  • Order number
  • Products to return
  • Reason for return
  • Name of the buyer or user
  • Pickup address

For Wabi Home, your satisfaction is very important; in order to offer you better service, it is essential that you provide us with all the requested information.

 

Defective or damaged product during transport:

If the buyer detects any damage to the packaging of the received products, it is important to record it on the carrier's delivery note and inform Wabi Home before opening the product.

If the product is damaged, the buyer must send an email to incidencias@wabihome.com indicating the order number and attaching photos showing the condition of the products to proceed with the exchange. Warranty:

All furniture purchased after January 1, 2022, has a 3-year warranty against manufacturing defects; for orders purchased before January 1, 2022, the warranty is 2 years. This warranty includes shipping, materials, and labor, but according to consumer goods warranty law, the product's inherent characteristics typical of its nature, as well as damages caused by misuse, are excluded from coverage. In the specific case of upholstered sofas, the warranty is 3 years.

This warranty does not include misuse of the product, transportation, accidents, or other damages not caused by the normal use of the products by the customer after product delivery.

Also excluded are damages caused by cleaning products containing chemicals (solvents, dyes, paints, etc.), as well as color deterioration due to sun exposure or temperature changes.

If the item is handled or repaired by personnel external to the company, it is not covered by the warranty.

To make use of the warranty, it is essential to present the proof of purchase by sending an email to incidencias@wabihome.com.

All transactions carried out on www.wabihome.com are subject to Spanish law.

In case of disagreement or dispute, the courts of the buyer's domicile are the courts of the buyer's domicile which, in accordance with applicable legal provisions, will hear the dispute.

If the buyer is domiciled outside Spain, both parties submit, with express waiver of any other jurisdiction, to the courts of Valencia (Spain).
