2. Terms of use and acceptance

Access to and use of the website, as well as placing orders through it, grants the status of user and implies full and unconditional acceptance of these General Terms and Conditions of Sale.

It is the user's responsibility to review these conditions at the time of starting the purchase process, as the conditions in force at that time will apply.

The user declares to be of legal age and to have sufficient legal capacity to enter into binding contracts according to applicable law.

These General Terms and Conditions of Sale may be modified at any time by Wabi Home and Living, S.L. However, such modifications will not affect orders placed before they come into effect, which will be governed by the conditions in force at the time of purchase.

Likewise, certain specific conditions may apply to particular products, which will prevail over these general conditions to the extent compatible.

The General Terms and Conditions of Sale will be available at all times for consultation and can be stored or reproduced by the user using the usual tools of their browser.

 

3. Purpose

This document aims to regulate the conditions under which users can purchase the products offered by Wabi Home and Living, S.L. through its website.

The contract is formalized by accepting these conditions at the time of purchase.

 

4. Purchase process

The purchase process is carried out electronically through the website and consists of the following stages:

  • Selection of products and their addition to the shopping cart.
  • Review of the cart contents, including products, quantities, prices, and associated costs.
  • User identification, either by registration or as a guest.
  • Entering shipping and billing information.
  • Selection of the payment method.
  • Final order confirmation.

Before completing the purchase, the user can review and modify the entered data, as well as detect and correct possible errors.

Once the order is placed, the user will receive a confirmation email acknowledging receipt. This email does not constitute final acceptance of the order, which will be subject, if applicable, to payment validation and product availability.

Wabi Home and Living, S.L. reserves the right to reject or cancel orders for justified reasons, such as errors in the provided data, lack of availability, or signs of fraud.

 

5. Prices, taxes, and shipping costs

All prices shown on the website are expressed in euros (€) and include applicable taxes, unless expressly stated otherwise.

Shipping costs are not included in the product price and will be itemized before completing the purchase process.

Shipping costs depend on the amount of your order and are calculated at the end of the purchase process as follows:

Wabi Home and Living, S.L. reserves the right to modify prices at any time. However, the applicable price will be the one in effect at the time the order is confirmed by the user.

The prices shown on the website are valid except in the case of obvious error. If an evident error is detected in the price of a product — including, by way of example and not limitation, typographical, technical, or configuration errors — that is objectively implausible in the context of the product (for example, a price significantly lower than the usual market price), Wabi Home and Living, S.L. reserves the right to cancel the affected order in whole or in part.

In case of cancellation for this reason, the user will be informed as soon as possible and a full refund of any amount paid will be processed, with no additional liability on the part of Wabi Home and Living, S.L.

 

6. Payment methods

Orders can be paid using the payment methods enabled at any given time on the website, which may include:

  • Credit or debit card.
  • PayPal.
  • Apple Pay.
  • Google Pay.
  • Amazon Pay.
  • Financing systems through third parties, such as Scalapay and SeQura, subject to approval by these entities.

In the case of financing methods, the granting of credit, payment terms, and formalization will be governed by the conditions established directly by the corresponding financial institution, with Wabi Home and Living, S.L. being unrelated to such contractual relationship.

The charge will be made at the time of order confirmation. If the payment is declined or unauthorized, the order cannot be processed.

 

7. Shipping and delivery

Wabi Home and Living, S.L. ships to Spain (except Canary Islands, Ceuta, and Melilla), Portugal (except Madeira and Azores), Austria, Germany, Belgium, France, Italy (except Sicily and Sardinia), Luxembourg, and the Netherlands.

Home delivery will be made Monday through Friday.

Once the product is available in stock, delivery times are approximate and depend on the type of product purchased:

  • Small format products: approximately 5 business days.
  • Larger volume products: approximately 10 business days.
  • Made-to-order products: additional production time.

For orders including multiple products, delivery may be made in a single shipment or in separate shipments.

Delivery will be made to the address provided by the user, who is responsible for the accuracy and truthfulness of the information given.

In case of delivery failure due to reasons attributable to the user, additional costs may be incurred for a new delivery.

Additional charges for transport and delivery will be communicated to the user during the purchase process, before confirming the order. The user can check the available shipping methods and their associated costs at any time in Shipping Conditions.

 

8. Order cancellation

The user may cancel their order as long as it has not been dispatched from our warehouse. Cancellation requests must be made exclusively through our REVER management portal.

If the order has already been shipped, cancellation will not be possible. In this case, the user must wait for its receipt and, if applicable, proceed to process the return through REVER.

Regarding orders for customized or made-to-measure products, cancellations will only be accepted if the manufacturing process has not started. Otherwise, the order cannot be canceled.

 

9. Right of withdrawal

In accordance with Spanish legislation, the user has the right of withdrawal, allowing them to return the received product if it does not meet their expectations.

Royal Legislative Decree 1/207, Art. 91.1 LGDCU, of November 16, allowing the right of withdrawal to be exercised within a maximum period of fourteen (14) calendar days from receipt.

Sofas and personalized or custom-made products according to customer specifications are excluded from the right of withdrawal, pursuant to the provisions of Article 103 of Law 3/2014, of March 27, which modifies LOCM art. 45. Consequently, returns or exchanges will not be accepted in these cases. Changes will only be made if the product is received with defects.

 

10. Return procedure

The processing of any return or exchange must be initiated through our REVER returns portal. This system will allow you to complete a guided form where the necessary documentation will be requested (photos of the product and original packaging, as well as a brief description of the reason for the return). Once the request is initiated, the user will have 24 hours to provide the required photos or documentation. Failure to send this information within the deadline will result in automatic cancellation of the request.

Upon receiving the request, REVER will send a confirmation email, whose purpose is to confirm the correct receipt of the process on our part.

All items subject to return must be sent in their original packaging and in perfect condition. We recommend keeping the packaging received. If it is not available, the user must replace it with equivalent packaging that guarantees proper protection of the product during transport (e.g., cardboard box and bubble wrap protection).

In case the product arrives damaged, used, or with signs of improper handling due to poor packaging preparation for transport, Wabi Home reserves the right to refuse the return or to apply a deduction of up to 50% of the refundable amount, in addition to deducting the corresponding shipping costs. The customer will be responsible for the decrease in value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and operation.

 

11. Refunds

Once the product is received at our warehouse and its condition verified, Wabi Home will proceed with the refund of the amounts paid by the user, excluding shipping costs.

The customer may choose to manage the return shipment by their own means or select the pickup service offered by Wabi Home.

  • Return managed by the customer: the customer arranges transportation by their own means, fully assuming the shipping costs and the risks of loss or damage during transport. It is recommended to purchase transport insurance to cover these contingencies. The product must be sent within a maximum of 5 calendar days from the confirmation of the return request to the following delivery address:

    Hours: Monday to Thursday from 09:00 to 14:00 and from 15:00 to 17:00.

  • Return managed by Wabi Home: Wabi Home can arrange the pickup of the order through a transport agency. In this case, the return shipping costs will be borne by the customer and deducted from the refund amount. These costs will be calculated based on the product price, following the indicative table below:

12. Incidents

The user will have a period of fourteen (14) calendar days from the receipt of their order to report any related issues.

If the packaging shows visible damage at the time of delivery, it must be explicitly noted on the delivery receipt from the transport company. This step is essential to manage any subsequent claims in case of breakage or damage. Therefore, it is recommended to thoroughly inspect the order as soon as it is received.

Incidents must also be reported through REVER, attaching photographs that clearly show the issue, along with a brief description. Once the request is initiated, the customer will have 24 hours to complete the required documentation; if not completed, the request will be automatically canceled, and a new process must be started.

 

13. Warranty

All furniture purchased from January 1, 2022, has a 3-year warranty against manufacturing defects; for orders placed before January 1, 2022, the warranty is 2 years. This warranty includes shipping, materials, and labor, but according to consumer goods warranty law, it excludes the product's inherent characteristics, those typical of its nature, as well as damages caused by misuse. Specifically, upholstered sofas have a 3-year warranty.

In cases where product replacement is applicable, we will take care of collecting the defective item as part of the replacement process at no additional cost to the customer.

This warranty does not cover misuse of the product, transportation, accidents, or other damages not caused by normal use of the products by the customer after delivery.

Damages caused by cleaning products containing chemicals (solvents, dyes, paint, etc.) as well as color deterioration due to exposure of the product to the sun or temperature changes are also not covered.

Likewise, any handling or repair carried out by personnel outside the company will void the warranty.

To make use of the warranty, it is essential to present the proof of purchase by sending an email to hola@wabihome.com.

 

14. Liability

Wabi Home and Living, S.L. will be liable to the user under the terms established in current consumer protection legislation, without prejudice to the limitations set forth in these General Terms of Sale.

Wabi Home and Living, S.L. will not be responsible for damages or losses that may arise from:

  • Errors, inaccuracies, or incomplete data provided by the user during the purchase process, especially regarding delivery addresses or contact information.
  • Delivery delays attributable to third parties, including transport companies or causes beyond the company's direct control.
  • Incidents arising from the inability to deliver due to the recipient's absence or unsuitable conditions at the delivery location.
  • Improper, negligent, or inappropriate use of the purchased products.
  • Incorrect handling, installation, or assembly of the products by the user or unauthorized third parties.
  • Damage resulting from inadequate packaging in case of returns managed by the user.
  • Force majeure circumstances or situations beyond the reasonable control of the company that prevent or delay the fulfillment of contractual obligations.

Likewise, Wabi Home and Living, S.L. shall not be responsible for actions or omissions of third parties involved in the contracting or delivery process, such as logistics providers or financial entities, without prejudice to the responsibilities legally applicable to them.

The liability of Wabi Home and Living, S.L., regarding any claim arising from the sale, shall be limited, to the maximum extent permitted by applicable law, to the amount actually paid by the user for the specific order that gave rise to such claim.

In any case, none of the provisions of this clause will limit the rights legally granted to the user as a consumer.

16. Applicable law and jurisdiction

These General Terms of Sale shall be governed and interpreted, in all matters not expressly provided for herein, in accordance with current Spanish legislation, particularly the regulations applicable to information society services and electronic commerce, as well as consumer and user regulations.

The language in which the contract is formalized is Spanish.

In case of dispute or conflict arising from the interpretation, validity, execution, or compliance with these conditions, the parties agree to submit to the courts and tribunals of the user's domicile, provided that the user qualifies as a consumer or user under applicable law.

If the user acts as a businessperson or professional, both parties expressly submit to the courts and tribunals of Valencia, waiving any other jurisdiction that may correspond to them.

In any case, nothing in this clause will affect the rights recognized to consumers by current legislation, which will be non-waivable when applicable.
